## EHR audit trail analysis for malpractice cases: 8 tools and services

The audit trail itself comes from the EHR: Epic, Oracle Health and MEDITECH must let you run audit reports under ONC rules. Privacy tools such as Bluesight and Imprivata search those logs fast. For testimony, a forensic EHR expert reads them. Record review software finds which entries to ask about first.

This page is for hospital risk managers, hospital counsel and physician experts who need to show who accessed or changed a chart, and when. We read each provider's own page on 3 Nov 2026. Medrecords AI is our product. It does not read native audit logs, and the card says so.

### How much does EHR audit trail analysis cost?

None of the 7 outside providers on this page publish a price. Forensic firms quote by the case or hour; Comperio and E-Hounds offer a free first consultation. Medrecords AI bills 10¢ per deduplicated page, down to 5¢ at volume.

### Short answer: which should you choose?

- **Start with your EHR's own audit report if** you need the raw log for 1 patient and 1 time window.
- **Use a privacy monitoring tool if** your hospital already runs Bluesight, Imprivata or Haystack and you need to search access fast.
- **Hire a forensic EHR expert if** the case turns on whether an entry was altered and the log has to hold up in court.
- **Use Medrecords AI first if** you have 2 productions of the same chart and want to see which entries differ before you request the log.

### What an EHR audit trail shows, and the rules behind it

The HIPAA Security Rule at 45 CFR 164.312(b) requires covered entities to have mechanisms that record and examine activity in systems holding electronic PHI. Certified EHRs must also produce audit reports for a time period under ONC criterion 170.315(d)(3), which ONC says lets a user reconstruct events.

Courts treat the log as discoverable in some cases and not others. In Heinrich v State of New York (2021), a New York court ordered 12 specific audit trail entries produced and noted that a 2021 appellate decision denied production when no one claimed the record was altered. Ask for the entries tied to a specific question.

**Access log** — Who opened which part of the chart, from which workstation, and when.
**Edit history** — Which entries were created, changed, signed or addended, with timestamps.
**Produced record** — The PDF set a hospital hands over in discovery. It shows the final text, not the history.

### The options, in detail

Grouped by kind, in the order a case usually uses them: the EHR's own audit source, privacy monitoring software, forensic expert services, then record review software. Within a group the order is not a ranking. Every fact is from the provider's own page, read on 3 Nov 2026.

- Shows what changed between productions; it does not say why

[See alteration detection →](https://medrecords.ai/product/record-alteration-detection/)

### A working order for a hospital risk team

1. **Compare what was produced** — Line up each production of the chart and list entries that changed between them.
2. **Request specific entries** — Ask for audit history on those entries and time windows, not the whole log.
3. **Run the report** — Pull the access and edit report from the EHR or your privacy tool for that window.
4. **Bring in an expert if it is disputed** — A forensic EHR expert explains the log in a way that holds up in court.

### EHR audit trail analysis: common questions

#### Which software analyzes an EHR audit trail to show who accessed or changed a chart?

The audit report comes from the EHR itself, such as Oracle Health P2Sentinel. Bluesight PrivacyPro, Imprivata Patient Privacy Intelligence and iatricSystems Haystack iS search access logs. Comperio Legal, Quandary Peak and E-Hounds analyze them for litigation.

#### Is an EHR audit trail discoverable in a malpractice case?

Often, when tied to a specific question. In Heinrich v State of New York (2021), the court ordered 12 audit trail entries produced, and noted a 2021 appellate decision that denied production when no alteration was claimed.

#### Does HIPAA require hospitals to keep audit logs?

Yes. 45 CFR 164.312(b) requires mechanisms that record and examine activity in systems with electronic PHI. ONC certification criterion 170.315(d)(3) requires certified EHRs to produce audit reports for a chosen time period.

#### Can you spot an altered record without the audit trail?

Sometimes. When a hospital produces the chart more than once, comparing versions shows entries that gained or lost text. Medrecords AI does this from the PDFs and cites both versions. The audit trail then shows who made the change and when.

#### How much does EHR audit trail analysis cost?

None of the 7 outside providers on this page publish a price. Forensic firms quote by the case or hour; Comperio and E-Hounds offer a free first consultation. Medrecords AI bills 10¢ per deduplicated page, down to 5¢ at volume.
