GUARDIANSHIP CAPACITY RECORD REVIEW

## A capacity petition rises or falls on functional evidence, not diagnoses.

Guardianship capacity record review services assemble what a capacity petition is decided on: diagnoses, cognitive testing with dates and scores, documented functional limitations, medication effects and each physician certificate on file, all cited to their pages. The capacity determination belongs to the clinician and the court.

### The statute names the evidence. The probate court weighs it.

We do not build for a case type until we can name the standard that defines a correct output and the person who grades the file against it. In guardianship and conservatorship petitions, both are already published.

The standard and the referee
The rulebook
- The forum state’s guardianship and conservatorship code, which specifies the physician or evaluator certificate the petition must carry and what it must address
- The Uniform Guardianship, Conservatorship, and Other Protective Arrangements Act, where the state has adopted it, which frames capacity as a functional question rather than a diagnostic one
- The American Bar Association Commission on Law and Aging and American Psychological Association handbooks on assessing older adults with diminished capacity
- The court’s own petition and certificate forms, which set the fields an evaluator has to complete

The referee
- The probate or surrogate court, which grants, limits or denies the petition
- The court visitor or guardian ad litem, who reads the same record and reports independently
- Counsel for the respondent, who cross-examines any limitation the record does not document

A petition continued because the certificate rested on a diagnosis alone

How it works

### 3 steps between the record and the petition.

01

#### Send the respondent’s records

Primary care and specialist notes, neuropsychological or cognitive testing, hospital records, medication lists and any prior evaluations, in any format.

02

#### We return the digest, page-cited

Diagnoses, testing with instruments and dates, the functional limitations the record actually documents, and the medications that bear on cognition.

03

#### The evaluator and the court decide

The clinician completes the certificate under their own license; the court decides whether and how far to limit rights. The digest is the cited record beneath both.

The boundary, in writing

### A digest of the record, not a determination of capacity.

We assemble and cite what the record documents. We do not assess capacity, complete or sign a physician certificate, opine on whether a guardianship should issue, or recommend the scope of any limitation. Those are clinical and judicial decisions, and they stay that way.

In the demo case, page 140 turned out to belong to a different patient. In a capacity file, a misattributed cognitive score is the kind of error that costs someone their rights, so it is quarantined rather than carried.

#### HIPAA, under a signed BAA

Every file is handled under our Business Associate Agreement, from the first byte.

#### Never trains a model

Your records are never used to train any AI model — ours or anyone else's.

#### Every line cited

If we can't cite it, we don't say it. Every sentence links to its source page.

Powered by the platform

### 7 capabilities behind every capacity record digest.

The capacity record digest is one deliverable of the same platform that reads, sorts, and cites the whole record.

[

#### Medical Records OCR

Every page read in full, including handwritten office notes where functional observations usually sit.

IN ACTION · 342 pp / 2 packets, read in full
](https://medrecords.ai/product/ocr/)
 [

#### Medical Chronology

Testing and functional entries assemble in date order, so decline or stability is visible rather than asserted.

IN ACTION · first evaluation → current status, one timeline
](https://medrecords.ai/product/chronology/)
 [

#### Verifiable AI Citations

Every limitation in the digest links to the entry that documents it. Diagnoses alone are not carried as limitations.

IN ACTION · digest → cited 100%

 [

#### Medical Summary Reports

It exports into the evaluator’s certificate worksheet or the petition exhibit in your format.

IN ACTION · digest → petition exhibit
](https://medrecords.ai/product/summaries/)
 [

#### Medical Record Deduplication

Forty charts pulled from multiple practices and EHR migrations carry their share of duplicate visit notes. Each is matched and collapsed to one canonical record, so the prescribing pattern is read once per real encounter.

IN ACTION · 40 charts → duplicate visit notes collapsed to 1 record each
](https://medrecords.ai/product/medical-record-deduplication/)
 [

#### Missing Records Identification

A prescribing pattern read across 40 charts is only as sound as the file behind it. When a chart references a visit, refill, or referral that never made it into the production, the gap is flagged before the pattern goes to the board.

IN ACTION · prescribing pattern cross-checked → gaps flagged before submission
](https://medrecords.ai/product/missing-records-identification/)
 [

#### Cross-Exam Simulator

A board investigator or defense counsel builds a case from the chart abstraction. This tool maps the questioning a physician facing that hearing is likely to face on the gaps and pattern in their own record. A rehearsal tool, not legal advice.

IN ACTION · prescribing pattern → likely hearing questions mapped

FAQ

### Guardianship capacity review, answered.

No. Capacity is determined by a qualified clinician on examination and by the court on the evidence. We assemble the cited record underneath that: testing, diagnoses, documented functional limitations and medication effects, each linked to its page.

Because modern guardianship statutes turn on function, not label. A dementia diagnosis is not itself evidence that a person cannot manage a specific decision. The digest carries documented functional observations separately, with pages, so the certificate can rest on them.

Yes. The same cited digest shows where a claimed limitation has no supporting entry, which is exactly what a court visitor or respondent’s counsel is looking for. The record does not change depending on who ordered the review.

No. Medrecords AI does not retrieve records from providers or facilities. You bring the records you already have — review starts in minutes from upload. Retrieval vendors take days; you can keep yours and still cut the review to minutes.

### Send one file. We'll tell you what we can read.

No obligation. If the case type is buildable we'll scope it; if it isn't, we'll say so.
