Write the standard of care, causation and merit reports

A Medical Malpractice case in Medrecords AI starts with 3 reports pre-selected: the Record Review, the Standard of Care Analysis and the Causation Analysis. You can also draft a Certificate of Merit Support Memo and an Affidavit of Merit. Each report is a cited draft for your expert to check, edit and sign.

The 3 default reports

ReportWhat it covers
Medical Malpractice Record ReviewRecords Reviewed; Summary of Care; Detailed Care Sequence; Results and Follow-up; Facts Identified for Expert Review; Body Systems and Conditions Involved; Damages Documentation; Medical Expenses (Billed Charges)
Standard of Care AnalysisRecords Reviewed; The Care at Issue; What Was Ordered; What Was Documented; Assessments and the Responses to Them; Communication and Escalation; Facts Identified for Expert Review
Causation AnalysisThe Question Presented; Records Reviewed; The Mechanism as Described; Onset and Temporal Sequence; Findings Consistent with the Claimed Mechanism; Findings Inconsistent With It, or Pointing Elsewhere; What the Records Do Not Say; Provider Opinions on Causation

The Standard of Care Analysis sets out what was ordered, what was done and how each finding was answered. It does not say whether the care fell below the standard. It ends with facts for your expert to review.

Merit papers for your expert

Some forums ask for a certificate or affidavit of merit. Medrecords AI has 2 reports for this.

  • Certificate of Merit Support Memo. Sections: The care at issue; The applicable standard of care, as the records state it; Documented departures; Harm; The causal question, framed; Who could sign, and what this forum requires; What is missing.
  • Affidavit of Merit. Sections: Caption; Qualifications; Records reviewed; Standard of care; Departure from the standard of care; Causation; Opinion of merit; Execution.

Both are drafts. The expert reviews and signs the affidavit, and the opinion in it is the expert's. Counsel checks the wording for the forum. Medrecords AI does not tell you the filing rules or deadlines for any state.

Other reports you can add

A Medical Malpractice case can also make a Damages Summary, Pre-existing Condition Analysis, Deposition Preparation Summary, Demand Package Narrative, Life Care Plan and Rebuttal. Any case type can make Missing Records & Gap Analysis and Case Strengths & Weaknesses.

A Rebuttal needs the other side's document uploaded first. Reading it costs 1 credit per page, on top of the report.

Create a report

  1. Press Report studio in the side menu.
  2. Press New report. The case must have finished processing.
  3. Pick the Case and the Report type.
  4. Check the Template. Your default shows first.
  5. Pick the Coverage: "Medical-legal" or "Medical only".
  6. Read the cost line, then press Generate.

You can make 1 report at a time per case. See create a report in Report Studio.

Check every report

  1. Press Run Verification and Cross-Examination. Each claim shows as Supported, Unsupported, Contradicted or Not checked.
  2. Read the likely lines of attack on the second tab.
  3. Open the source for every fact you plan to quote. See check any fact against its source page.
  4. Compare the results section with your own list of results and responses. See find delays between abnormal results and provider action.

Use your own layout

You can copy a built-in template with Duplicate, or build 1 from up to 6 of your past reports. Set it as your default for Medical Malpractice. See set up report templates.

Medrecords AI organizes and cites the records. Its output is not a medical or legal opinion and does not replace your expert.
