Set up a personal injury case, and when to pick MVA instead

In Medrecords AI, pick Personal Injury for falls, premises cases, dog bites and other injuries that are not crashes. Pick Motor Vehicle Accident (MVA) for any crash: car, truck, motorcycle, bike or pedestrian. MVA adds crash details to check before you confirm. Personal Injury has no extra fields beyond the forum state.

Car or truck crashMotor Vehicle Accident (MVA)
Motorcycle or bike crashMotor Vehicle Accident (MVA)
Pedestrian hit by a vehicleMotor Vehicle Accident (MVA)

A fall in a care home is a different case. Use Nursing Home Neglect for that. See choose the right case type.

Your role only changes the order of the list. Every role can pick either type.

Create the case

  1. Start a new case and pick the case type.
  2. Upload all the records for 1 claimant. See upload the right records and bills.
  3. Keep Remove duplicate pages on. It sits under Before processing.
  4. Wait for the first read of the records to finish.

The confirm window

When the first read is done, the case status says Needs confirming. The Confirm case details window opens. Check it with care. You cannot edit these details after you confirm.

What to check on both types:

  • Key date. On Personal Injury it is called "Date of injury". On MVA it is called "Date of collision". Make sure it is the day of the incident or crash.
  • Body parts. Remove any that are not part of the claim. Add any the app missed.
  • Focus. Keep only what the claim is about.
  • Forum state. This is where the matter is filed. It may not be where the treatment happened.

The window has a section called Case details. Nothing there is required. A field you leave empty is saved as not stated in the records. The app fills in what it can find. An empty choice shows "Not stated in the records".

The MVA crash fields

On an MVA case, the Case details section adds these fields. Check each 1 against the records.

FieldChoices
Claimant's roleDriver, Passenger, Pedestrian, Cyclist, Motorcyclist, Other
Manner of collisionRear-end (front to rear), Side impact / angle (T-bone), Head-on, Sideswipe, Rollover, Single vehicle / fixed object, Pedestrian or cyclist struck, Other
Restraint useBelted, Unbelted, Not stated
Air bagDeployed, Not deployed, Not stated
Transport from the scene / first careBy ambulance from the scene, Self-transported same day, First care on a later day, No care sought that day, Not stated
Property damageMinor, Moderate, Severe, Total loss, Not stated

The section also has Police report number and Coverage and liens. Check them against the crash report and any lien letters.

The property damage choices Minor, Moderate and Severe each mean "as stated" in the records. They are not the app's view of the crash.

The collision as documented

MVA cases also show a section called The collision as documented. You can read it but not change it. It shows what the crash report, the EMS records and the first visit say about the crash. It also shows who paid. Use it to check the crash fields above. If the records disagree with each other, note it. The analysis step shows how to set the accounts side by side.

Confirm

  1. Press Confirm and continue. Confirming is free.
  2. Write your reports later in the Report studio. A new report costs 100 credits and includes 1 verification and cross-examination run.

The full steps are in confirm the case details. For why the crash facts matter in a demand, read our demand letter drafting page.

Medrecords AI organizes and cites the records. Its output is not a medical or legal opinion and does not replace your expert.
