Set up a mass tort case: product, exposure period, MDL docket

To set up a mass tort case in Medrecords AI, pick Mass Tort & Product Liability and upload 1 claimant's records. After the first read, the Confirm case details window opens. You check the product, the exposure period and the MDL docket there. These details lock when you confirm, so check them with care.

Before you start

  • Make 1 case for each claimant. A case cannot hold more than 1 person.
  • Gather all of that claimant's records first. PDF, Word, images, text and ZIP files work. TIFF, GIF and HEIC files are not read, so save them as PDF or JPG. See which files you can upload.
  • You pay 1 credit for each page you upload.

Pick the case type

Pick Mass Tort & Product Liability in the case type list. Your role only changes the order of the list. Every role can pick every case type. See choose the right case type.

This case type pre-selects 3 reports: Record Review, Causation Analysis and Damages Summary. You can remove any of them before you confirm. A report is charged only when you confirm it.

Fill in the case details

When the first read is done, the case status changes to Needs confirming. The Confirm case details window opens. It has a section called Case details. Nothing there is required. A field left empty is recorded as not stated in the records.

The app fills in these fields from the records where it can. You check them and change them.

FieldWhat to enter
Forum stateThe state where the claim is filed
ProductThe product as the records name it, such as a drug or a device
Exposure periodWhen use started and when it stopped
MDL docketThe MDL docket for the case, if there is one. MDL means multidistrict litigation

Product, Exposure period and MDL docket are free text. Type the product name the way the records print it. An empty field shows "Not stated in the records".

Check the focus and key date

On a mass tort case, the focus is the claimed injuries. There is no body parts list on this case type.

  1. Read the case summary and fix anything wrong.
  2. Remove focus items that are not part of the claim. Type a missing injury in "+ add your own".
  3. Check the key date. On this case type it is called "Start of exposure", such as the implant date or the first dose. Press Make primary on the right date. Use Add date for others, such as a removal surgery, and add a note to each.
  4. Press Confirm and continue. Confirming is free. You write reports later in the Report studio.

You must keep at least 1 focus item or a main key date.

What you cannot change later

After you confirm, the case details, focus and key dates lock. If you add records later, the confirm window opens again and you can update your answers then. See add records to an existing case.

Set up the next claimant the same way

Use the same product wording on every claimant's case. It makes reports easier to compare. Set a default report template for this case type, so each new case starts with the same layout. See set up report templates.
