Which report should you write for a birth injury case?

A birth injury file runs as Medical Malpractice in Medrecords AI, so it uses the Medical Malpractice reports. 3 start pre-selected: Medical Malpractice Record Review, Standard of Care Analysis and Causation Analysis. You can add others, such as a Damages Summary or a Life Care Plan. There is no report made only for birth injury.

The 3 pre-selected reports

ReportWhat it coversSections
Medical Malpractice Record ReviewThe whole course of careRecords Reviewed; Summary of Care; Detailed Care Sequence; Results and Follow-up; Facts Identified for Expert Review; Body Systems and Conditions Involved; Damages Documentation; Medical Expenses (Billed Charges)
Standard of Care AnalysisWhat was ordered, done and chartedRecords Reviewed; The Care at Issue; What Was Ordered; What Was Documented; Assessments and the Responses to Them; Communication and Escalation; Facts Identified for Expert Review
Causation AnalysisWhat the records say about how the harm came aboutThe Question Presented; Records Reviewed; The Mechanism as Described; Onset and Temporal Sequence; Findings Consistent with the Claimed Mechanism; Findings Inconsistent With It, or Pointing Elsewhere; What the Records Do Not Say; Provider Opinions on Causation

For a birth injury file, the Detailed Care Sequence and Communication and Escalation sections are where labor events tend to show up. Check them against the facts you found in the analysis step.

Other reports you can add

  • Damages Summary for treatment burden, function and future care as documented.
  • Life Care Plan for future care needs.
  • Deposition Preparation Summary for providers, witnesses and contradictions.
  • Certificate of Merit Support Memo and Affidavit of Merit. These are drafts for your expert to review. Counsel checks the wording for the forum.
  • Pre-existing Condition Analysis, Demand Package Narrative and Rebuttal.
  • Missing Records & Gap Analysis and Case Strengths & Weaknesses, which any case type can make.

A Rebuttal needs the other side's document uploaded first. Reading it costs 1 credit per page on top of the report.

Make a birth injury template

You can save your own layout for birth injury files.

  1. Open Settings, then Report templates.
  2. Press Duplicate on a built-in Medical Malpractice template, or build 1 from up to 6 of your past reports.
  3. Name it, such as "Birth injury record review".
  4. Under Applies to, pick Medical Malpractice.

Before you send a report

Medrecords AI organizes and cites the records. Its output is not a medical or legal opinion and does not replace your expert.
